If you are modding a game, and it supports GMax, then it's a powerful tool, and the best for the job. GMax, which is indeed a stripped down version of 3DMax, is only meant for modding, and it does exclude a lot of the common plugins that 3DMax has. You don't explicitly license it from discreet for a specific game.
